We work hard to provide high quality legal services at a reasonable rate. Fees are based upon the type of representation. We require an initial retainer for most of our cases. (The amount of the retainer depends on the type of case.)

We offer flexible payment plans. Currently, our fee structure is as follows:

Bankruptcy:

Individuals and Married Couples filing personal bankruptcy:

Chapter 7: $1000-$1500, plus court filing fee. The fee is based on the size, complexity, and time sensitivity of the case.  The standard fee is $1300.

Chapter 13: $3250, plus court filing fee. (For non-base matters, we charge per hour at our customary rate (see below) or the amount set forth in the “fee disclosure” promulgated by the Bankruptcy Court for the Western District of North Carolina and filed in each ch 13 case.)

Businesses filing bankruptcy:

Chapter 7: $2000-5000, plus court filing fee.

Chapter 11: We charge per hour at our customary hourly rate (see below). The amount of the retainer depends on the size and complexity of the case (usually between $5000-$15,000).

Adversary proceedings:

We charge per hour at our customary hourly rate (see below). The amount of the retainer depends on the size and complexity of the case (usually between $3500-$10,000).

Business Law and Civil Litigation:

We charge per hour at our customary hourly rate (see below).

Trademark and Copyright Law:

We charge per hour at our customary hourly rate (see below).

Other matters:

Your particular issue or problem may not be addressed above. Rod Kight can usually give you an estimate of the total fees for your case, and can often work out a payment plan after the initial consultation. Most matters not described above will be billed at our customary hourly rate (see below).

Hourly Rate:

For matters that are billed hourly, the rates are as follows:

Rod Kight (attorney): $295 for bankruptcy matters and $265 non-bankruptcy matters

Amita Dhaliwal (attorney):  $225 for all matters

Non-attorney staff:  $80 for all matters

Kight Law Office charges an initial consultation fee of $80.
This fee will be waived if you retain Kight Law Office to represent you. Why do we charge an initial consultation fee?

If you cannot afford a lawyer:

You should call a legal aid organization. We recommend Pisgah Legal Services (PLS) or Sylva Legal Aid (SLA).  PLS’s phone number is 828-253-0406; SLA’s phone number is 828-586-8931. Both of these organizations are non-profit legal services agencies serving indigent residents of Western North Carolina. In addition to performing high quality legal work “in house”, they refer cases out to lawyers who focus or specialize in various areas of law. (For instance, we often accept pro-bono referrals of bankruptcy and consumer protection matters from PLS and SLA.)

Each case is different and presents its own set of unique issues. Accordingly, the fees set forth above are base fees for standard representations. Kight Law Office reserves the right to set a different fee than those set out above for time sensitive, highly complex and/or unusual matters.
